Legal Alert: Department of Labor Releases New FMLA Poster

The United States Department of Labor has released a new, more user-friendly FMLA poster entitled Your Employee Rights Under the Family and Medical Leave Act, which can be accessed here.



Employers should replace the prior, April 2016 poster with this new one as soon as possible.



The poster describes FMLA leave, eligibility for FMLA leave, how to request FMLA leave and the employer’s obligations under the law. As a reminder, the poster should be placed in a conspicuous location in the workplace where notices to employees are customarily posted. In addition to physical posting, employers should post the notice digitally on the company’s intranet.



As the content of workplace notices change frequently (ex: the Equal Employment Opportunity Commission is in the process of updating its Know Your Rights poster to include information on the Pregnant Workers Fairness Act) we recommend that employers engage a vendor that can supply current and consolidated posters for both federal and state laws. Alternatively, employers should periodically visit the Department of Labor and other agency websites to ensure they are utilizing the most up-to-date posters.
